interesting not only on account of its startling develop ments but for the overbearing demeanor of the accused and his subordinates The former did not appear at first disposed to consider the charge serious lor he displayed the greatest un concern and almost insulted the Judge As the trial progressed he became however somewhat alarmed though apparently still convinced of being in the right and a victim of persecution But even this consolation must have altogether forsaken him towards the close or he would never have thought it ad visable to forfeit bonds to such a amount We deem this case of great importance for all who have ever been brought into contact with emigrant vessels or have perhaps crossed the ocean themselves must be aware that such treatment as the passengers of the Villafranea experienced Is no exceptional occurrence Capt Anderson may have only a de gree more brutal than the generality of his professional brethren whose tyranny haa so often been a subject of comment and who con sider their passengers as so much freight to be expedited in the cheapest and' quickest manner deserving less attention than cattle In the eyes of these men emigrants have no rights that sre entitled to respect and what bannnnj in this case has ho doubt happened in many others of which nothing has ever been heard Indeed as no exemplary punishment ever fol lowed these outrages time and impunity seemed almost to have sanctioned the evil It' is therefore well that the courts should at last have taken notice of these practices for the lesson taught in the Villafranca Is it not absolutely false that the clergyman who re fuses is not punished for what he has heretofore done axxl for which ho Such penalty was at tached when the offence was committed when if he refuses he is deprived of his profession And yet this is the reason given why the law is not ex post' facto Is it not ridiculous to call this for the when it re lates to past acts for which it provides the pun ishment of deprivation of support? 5 A high legal authority has pronounced this decision peculiar and we think that under the circ*mstances we never heard a milder ex pression of
